1. Acceptance of Terms

By accessing or using CalmIQ Pro ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users including school staff, parents, and administrators.

2. Description of Service

CalmIQ Pro is a behavioral observation and communication platform for special education classrooms. It enables school staff to log student observations, generate AI-powered daily reports, and share information with families of neurodivergent students.

3. School Responsibilities

  • Schools are responsible for ensuring appropriate parental consent is obtained before recording student information.
  • Schools must ensure that only authorized staff have access to the school dashboard.
  • Schools are responsible for the accuracy of data entered into the platform.
  • Schools agree to use CalmIQ Pro in compliance with FERPA, IDEA, and any applicable state education privacy laws.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any regulations.
  • Enter false, misleading, or harmful information about any student.
  • Share your login credentials with unauthorized persons.
  • Attempt to access data belonging to other schools or users.
  • Reverse engineer, copy, or redistribute any part of the Service.

5. AI-Generated Content

CalmIQ Pro uses artificial intelligence to generate daily observation summaries. These summaries are intended to assist communication and should not be used as the sole basis for clinical or educational decisions. AI-generated reports are not a substitute for professional judgment by qualified educators or behavioral specialists.

6. Beta Service

CalmIQ Pro is currently offered free of charge during its beta period. We reserve the right to introduce paid plans in the future. We will provide reasonable notice before any free tier limitations are introduced.

7. Limitation of Liability

CalmIQ Pro LLC provides the Service "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

8. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. You may delete your account at any time by contacting us at privacy@calmiqpro.com.

9. Governing Law

These Terms are governed by the laws of Washington State, United States. Any disputes shall be resolved in the courts of Washington State.
